The Indiana Court of Appeals issued a ruling today in the matter of Brennen Baker vs. Tremco and it is a major victory for taxpayers!!!
Baker, a former Tremco employee, resigned his position as a sales representative because his conscience would not allow him to be part of the illegal bidding scheme. Tremco claimed Baker violated a no-compete agreement when he started his own roofing company. Baker says he wasn't bound by the agreement because Tremco had unclean hands due to the illegal bidding scheme.
Judge Judith Profitt was overturned once again, which is no surprise to many who are familiar with her rulings.
Tremco has been using two arguments against taxpayers, which have now been effectively removed. Tremco claimed they had been exonerated by the Attorney General. We now know that's not true. They also claimed that Judge Proffitt's erroneous ruling also exonerated them, and now we know that's not true.
This is a major victory for Indiana taxpayers!!!! More details to come! Stay tuned.
